Cabinetworx – Terms and Conditions
Please read these Terms and Conditions carefully before using the Cabinetworx.com.au website or related services.
By accessing or using our website or placing an order, you agree to be bound by these Terms and Conditions (“Agreement”).
Cabinetworx reserves the right, at its sole discretion, to modify or replace these Terms at any time. If you disagree with any part of this Agreement, you must discontinue use of the Service immediately.

A – Definitions
A-1 “Ts & Cs” refers to these Terms and Conditions and may also be called the “Contract” or “Agreement.”
A-2 “Website” refers to the Cabinetworx website located at www.cabinetworx.com.au and any related sub-pages or digital platforms operated by Cabinetworx.
A-3 “Us,” “Our,” and “We” mean the Cabinetworx business entity and its successors, assigns, and related entities.
A-4 “User” means any individual or business accessing the Website, purchasing Goods or Services, or acting on behalf of such a person or entity.
A-5 “Goods” or “Services” refers to all products, components, and associated services supplied by Cabinetworx as described on the Website, order forms, quotations, invoices, or related documents.
B – Acceptance
B-1 Use of the Website or any Service provided by Cabinetworx constitutes acceptance of these Terms and Conditions.
B-2 Any verbal or written statements made by Cabinetworx representatives that contradict these Terms are not binding unless expressly confirmed in writing by Cabinetworx management.
B-3 All quotations, estimates, or issued documents are indicative references only. Cabinetworx does not guarantee the continued validity of any quoted price.
The live pricing displayed on the Cabinetworx website shall always constitute the prevailing price reference for all orders. Any refund will be processed strictly in accordance with Cabinetworx’s Refund Policy.
C – Payment
C-1 The “Price” of Goods or Services shall be the live price displayed on the Cabinetworx website at checkout or as otherwise confirmed in an official invoice.
C-2 Cabinetworx operates strictly on a payment-in-advance basis. Goods will not be manufactured or released until full payment has been received and cleared.
C-3 All delivery and supply charges must be paid in full by the User before dispatch. Failure to pay may result in storage, re-handling, or administrative fees.
C-4 The order commencement date is the date Cabinetworx confirms full payment.
C-5 The User is solely responsible for ensuring that all measurements and details provided are correct. Any additional work or costs arising from user error will be charged to the User.
C-6 The User has two (2) business days after order commencement to request minor changes in writing. Changes beyond this timeframe may not be accepted and may result in cancellation or administrative fees.
C-7 Any accepted change after commencement will incur a $75 administration fee, payable before processing continues.
D – Measurement Responsibility
D-1 Cabinetworx manufactures all products strictly according to the measurements and specifications provided by the User.
D-2 The User is solely responsible for the accuracy and suitability of all measurements and layouts.
D-3 Cabinetworx accepts no liability for any inaccuracy, fitment issue, or adjustment required due to incorrect or incomplete measurements provided by the User.
D-4 The User must review and confirm all details before payment. Cabinetworx will manufacture strictly according to the information received.
E – Delivery
E-1 Delivery may be arranged by Cabinetworx at the User’s expense. All delivery fees are payable upon order confirmation.
E-2 Cabinetworx may use third-party carriers. These carriers act as independent contractors, not as Cabinetworx agents. Claims for loss or damage in transit must be directed to the carrier under their terms. Cabinetworx will use reasonable efforts to assist with claims but does not assume liability for carrier actions.
E-3 Cabinetworx retains ownership of all Goods until payment is received in full. No Goods will be dispatched prior to cleared payment.
E-4 Delivery to a nominated depot is deemed complete once the Goods are made available for collection. Cabinetworx is not responsible for depot delays or third-party handling. Once collected, all risk and responsibility transfer to the User. The User must inspect the Goods before leaving the depot or premises and report any visible damage immediately.
E-5 While Cabinetworx will make every effort to deliver to the depot closest to the User’s address, depot locations may vary due to third-party logistics. If a change occurs, Cabinetworx will allocate the nearest available alternative depot.
E-6 Any delivery or availability dates are estimates only. Production and transport schedules may vary based on materials, logistics, or other factors beyond Cabinetworx’s control. Delays do not entitle the User to cancellation or compensation.
E-7 (Change from Pickup to Depot Delivery)
If the User initially selects “Factory Pickup” but later requests delivery to a depot or other location, Cabinetworx reserves the right to charge additional fees for freight and re-packaging. Depot deliveries require different packaging standards.
If the User arranges their own transport or fails to follow Cabinetworx’s delivery procedures, all associated risks and costs rest solely with the User.
F – Storage and Uncollected Goods
F-1 If the User fails to collect Goods within seven (7) days of notice of availability, Cabinetworx may charge storage or handling fees.
F-2 Cabinetworx is not liable for any deterioration, warping, or damage to Goods due to extended storage beyond this period.
F-3 Goods uncollected after thirty (30) days may be treated as abandoned and resold or disposed of without notice. Payments made will be forfeited to cover associated costs.
F-4 Re-manufacture of abandoned Goods will be charged at current rates.
F-5 Delayed collection does not entitle the User to refund or credit.
G – Defects and Colour Variation
G-1 (Inspection):
The User must inspect Goods immediately upon pickup or delivery and report any defect or shortage in writing within two (2) business days. After this period, Goods are deemed accepted as compliant, fit for purpose, and free from defect to the extent permitted by law.
G-2 (Scope of Responsibility):
Cabinetworx is responsible only for defects arising from manufacturing or material faults. Damage caused by misuse, handling, installation, transport, or modification is excluded.
G-3 (DIY Assembly):
Flatpack products require basic tool-handling skills. Cabinetworx does not provide full installation instructions or supervision. The User must assemble and install Goods correctly using reasonable workmanship. Cabinetworx is not liable for damage or misalignment caused by incorrect assembly.
G-4 (Remedies):
For valid defect claims, Cabinetworx may, at its discretion:
(a) repair or replace defective Goods;
(b) re-supply affected Services; or
(c) refund the amount paid for the defective component.
Refunds apply only to defective parts unless the defect constitutes a major failure under the Australian Consumer Law.
G-5 (Supplier Availability):
Cabinetworx cannot guarantee the ongoing availability of any specific colour, material, or finish. All materials are sourced from external suppliers such as Polytec or Laminex, and stock levels or discontinuations are outside Cabinetworx’s control. In the event a selected colour becomes unavailable, Cabinetworx will notify the User and offer the closest available alternative or a full refund for the affected item.
G-6 (Colour Variation and Image Representation):
All colours, textures, and finishes displayed on the Website are for reference only. Variations in lighting, display settings, and material batches may cause differences between images and actual products. Users should verify selections by obtaining physical samples (e.g., Polytec, Laminex). Cabinetworx accepts no liability for colour variation or digital misinterpretation.
H – Title, Ownership, and Order Validity
H-1 Only orders placed through the Cabinetworx website or paid in full are valid. Emails, verbal confirmations, or informal approvals do not constitute binding orders.
H-2 Ownership passes to the User only once full payment is received and the Goods are ready for collection or delivery.
H-3 While Goods are held by Cabinetworx prior to collection, they remain at the User’s risk only to the extent required by law.
H-4 Cabinetworx may withhold release until payment is cleared. Uncollected Goods may be treated as abandoned under Section F.
H-5 The User must not assign or transfer ownership before pickup or delivery.
H-6 Cabinetworx does not offer credit. All sales are payment-in-advance.
I – Our Liability
I-1 To the fullest extent permitted by law, Cabinetworx’s liability is limited to remedies required under the Australian Consumer Law.
I-2 Cabinetworx is not liable for any consequential, indirect, or financial loss (including profit, business, or data loss) arising from the supply, delay, or use of the Goods.
I-3 Liability is limited to the total price paid for the specific Goods or Services concerned.
I-4 Cabinetworx accepts no liability for third-party carriers or for reliance on advice not confirmed in writing. Any design or layout suggestions are provided as general guidance only and do not constitute professional advice.
I-5 Nothing in these Terms limits rights under the Australian Consumer Law.
J – Cancellation
J-1 Cabinetworx may cancel or refuse an order before manufacturing begins by giving written notice. Any payment received will be refunded in full, and this refund will constitute full settlement of any claim.
J-2 Cabinetworx is not liable for indirect or consequential loss arising from cancellation.
J-3 Once manufacturing or material procurement has commenced, orders cannot be cancelled. Refunds will only apply as required under the Australian Consumer Law.
J-4 Nothing in this section limits statutory rights under the Australian Consumer Law.
K – Indemnity and User Responsibility
K-1 (User Indemnity):
The User indemnifies Cabinetworx, its employees, and contractors against any loss, claim, or cost arising from:
(a) any breach of these Terms by the User;
(b) incorrect information, measurement, or specification provided; or
(c) misuse, alteration, or incorrect assembly of the Goods.
K-2 (No Guarantee or Security):
Cabinetworx provides no credit, guarantee, or security arrangements. All orders are prepaid.
K-3 (Continuing Obligation):
The User’s indemnity obligations survive delivery and continue for any resulting claim or liability.
L – General Terms
L-1 (Severability):
If any provision is invalid or unenforceable, the remaining provisions remain in effect.
L-2 (Governing Law):
This Agreement is governed by the laws of Australia and the State of Victoria. Any dispute shall be subject to the exclusive jurisdiction of the courts of Victoria.
L-3 (No Set-Off):
The User may not offset any claim against amounts due to Cabinetworx.
L-4 (Sub-Contracting and Assignment):
Cabinetworx may assign or subcontract its obligations without consent but remains responsible for performance.
L-5 (Force Majeure):
Neither party is liable for delay or failure caused by events beyond reasonable control, including but not limited to natural disasters, strikes, or transport interruptions.
L-6 (Waiver of Rights):
Failure by Cabinetworx to enforce any right under these Terms shall not be deemed a waiver. All User obligations remain in full effect.
M – Product Inclusions and Limitations
M-1 (Base Cabinets):
Adjustable legs are included where applicable.
M-2 (Doors and Hinges):
Hinges are supplied for any ordered doors.
M-3 (Drawers and Runners):
Drawer runners are included for all drawer cabinets.
M-4 (Exclusions – Screws and Fixings):
Flatpacks do not include screws, caps, or wall plugs unless ordered with assembly service.
M-5 (Exclusions – Shelf Supports):
Shelf supports are not included unless specified.
M-6 (User Responsibility):
Users must ensure fittings are suitable and properly installed. Cabinetworx is not liable for damage caused by misuse or negligent installation.
M-7 (DIY Assembly Skill and Tool Requirements):
Flatpack assembly requires basic trade-level skill and tools such as a screwdriver, impact driver, and drill. Cabinetworx does not supply tools or provide on-site assistance. Minor trimming or adjustment may be required due to site or measurement variances.
M-8 (Colour Variation and Image Representation):
Images are for reference only. Variations in lighting, display settings, or batch differences may occur. Users should confirm colours using physical samples from suppliers. Cabinetworx is not responsible for perceived colour mismatches.
